Bonington Loans Ltd is authorised and regulated by the Financial Conduct Authority under firm reference number 805272. Some of the lending we provide is regulated by the Financial Conduct Authority and some is not — business lending to a limited company is generally unregulated, while lending secured against an individual's home may be regulated. We will tell you which applies to your loan. We handle your personal information in the same way either way. The particulars of our authorisation can be viewed on the Financial Services Register (register.fca.org.uk).

What personal information do we collect from you?

We collect the personal information necessary to enable us to decide whether to lend to you, to arrange the security for that lending, and to exercise our rights and duties under any resulting agreement. The personal information we process in order to provide secured business lending is as follows:

We may need to collect identification and proof of address documents from you such as your passport, driver's licence, utility bill and council tax as part of our Customer Due Diligence process. We may retain a copy of your proof of identity and address information.

Information about other people

If you give us the details of a joint owner, a guarantor, or anyone else connected to the property or the business, you are giving us personal information about someone else. Please make sure they know you are doing so. We will use their details only to assess and, if it proceeds, to arrange the lending, and we will contact them directly where the process requires it — for example so that they can take their own independent legal advice.

What personal information do we collect from third parties?

When you open an account or apply for lending, we may need to collect information about you from:

Credit Reference Agencies may provide us with public information (such as that found on the electoral register) and shared credit and fraud prevention information. When we request a credit reference, this places a search 'footprint' on your credit file that may be seen by other lenders.

The borrowing calculator on this website runs no credit search. We will tell you clearly at the point in the process where a search is needed.

Why do we collect and use your personal information?

We use your personal information to send marketing communications to you about similar products and services that may be of interest to you. We will send our marketing communications to you by email. You can object to your personal information being used by us to send you marketing information. Each marketing email will include an unsubscribe link to enable you to opt-out of receiving future marketing communications.

What is our lawful basis for handling your personal information?

Under the UK General Data Protection Regulation we must have a lawful basis to legally handle your personal information. The lawful basis that we rely upon are as follows:

  1. Contract — to take steps, at your request, to enter into a credit agreement and to perform our obligations under that contract;
  2. Legal obligation — to share personal information with law enforcement agencies and regulatory bodies if required to do so by law and to fulfil our legal and regulatory obligations as a lender; and

Legitimate interests — to use your personal information to send you marketing communications about similar products and services in the future, to share your personal information with third party professional service providers that we engage, and to share your personal information with our successors in the event of a merger or acquisition.

What happens if I do not provide my personal information?

We need your personal information in order to provide our lending service to you. If we do not collect your personal information, we will not be able to provide our service to you.

Who will we share your personal information with?

We may need to share your personal information with Credit Reference Agencies.

We may share your personal information with law enforcement agencies, fraud prevention agencies and regulatory bodies such as the FCA and HMRC when required to do so by law.

We may share your personal information with valuers and solicitors instructed in connection with a specific transaction, and with any existing mortgage or charge holder whose consent is required.

We may engage the services of professional advisers such as compliance consultants, lawyers and accountants who may be given access to your personal information in order to provide their services to us. We will ensure that your personal information is protected by obtaining a written undertaking of confidentiality from the professional service providers.

In the event that we are subject to a merger or acquisition we may share your personal information with the organisations that acquire or merge with our business and their professional advisers in the course of the transaction and thereafter. In such circumstances the latter organisation will be required to use your personal information in the same ways described in this privacy policy.

Who processes your personal information on our behalf?

Transferring your personal information outside Europe

We will not share your data outside of Europe. This means that we will not share your personal information, as a matter of course, with organisations domiciled in jurisdictions that are not subject to the UK GDPR.

How long will we store your personal information?

We will store your personal information for up to six years from ceasing to be our client. This is to enable us to refer to our records in the unlikely event that you want to lodge a complaint against us within six years.

If you do not exercise your right to object to marketing or unsubscribe to our marketing emails, we will store your personal information for marketing purposes until you exercise your right to object or unsubscribe.

Rates and representative example

For business purposes only. Secured against property or land. We do not offer personal loans or consumer credit. Terms from 6 to 18 months.

Representative example: borrow £250,000 over 18 months at 1.75% per month (fixed; 21% per annum), secured against commercial property. A 10% arrangement fee of £25,000 is added to the loan, making a total facility of £275,000. Pay 18 monthly interest-only payments of £4,812.50, plus £275,000 capital at the end of the term. Total interest: £86,625. Total amount repayable: £361,625. Representative APR: 32.6% APR.

Your property may be repossessed if you do not keep up repayments on a loan secured against it. Think carefully before securing other debts against your home.

Rates start from 1.75% per month and depend on the amount borrowed, security and assessment. This example is not an offer of credit. Your actual rate, fees and total cost will be confirmed in writing before you enter into any agreement.
